Our terms of use
1. Scope of application
The seller is defined below as the company PALIMEX, whose registered office is located at 40 rue de PROVENCE – BLDG D9 / PLA 438 – 94 619 RUNGIS MIN CEDEX (France). The customer is defined below as the natural person signing and accepting these terms of sale.
The general terms and conditions of sale are presumed to be fully accepted upon confirmation of the order by the customer on our order module. All our quotes, order forms or invoices imply full acceptance of our terms of sale by the customer.
Our ongoing sales and contracts are subject to these general terms and conditions of sale, except for any specific written waiver agreed between the seller and the customer. Our general terms and conditions of sale replace and cancel any other general terms and conditions of purchase of the customer.
These general terms and conditions of sale govern current and future relations between the customer and the seller.
We reserve the right to modify the general terms and conditions of sale without prior notice.
2. Order
2.1. Conclusion of the contract
The date of conclusion of the contract is the date on which the customer placed the order and accepted the general terms and conditions of sale. Sales made by the seller are perfect between the parties and ownership is transferred to the customer upon validation of full payment of the order(s). Sums paid before delivery are therefore deposits.
The validation of the order is FIRM AND FINAL.
2.2. Product description
The essential characteristics of the product are indicated in the "product sheet" generally containing a photo of the product and indicating its main features.
The photographs illustrating the products, in support of the text, do not fall within the contractual scope; if any errors have been introduced, the seller's liability cannot in any case be engaged. The detailed product sheet is the only contractual source. Manufacturers may change the technical composition of product references without prior notice. The seller is entitled at any time to update, improve its sheets or withdraw its products from sale. It is your responsibility, if you do not consider yourself sufficiently competent, to be assisted by an adviser.

The products offered comply with French legislation in force and with the standards applicable in France and within the EU.
2.2.1 Use-by date / Best-before date
For fresh products "USE-BY DATE MINIMUM 15 days guaranteed upon shipment"
For dry products "BEST-BEFORE DATE MINIMUM 3 months guaranteed upon shipment"
2.3. Price
Prices are indicated in Euros EXCLUDING TAX and EXCLUDING delivery charges. Products are supplied at the price in force at the time the order is placed.
They are likely to vary, particularly in the event of a change in the VAT rate. Prices may be modified without notice from the seller and may be subject to variation of raw materials. However, the prices appearing on your order after its validation and registration are firm and final: if prices drop a few days after the order, we will not be able in any case to compensate you for the difference; if prices increase, we are committed to delivering to you at the price set on the day of the order. If you are a customer outside the European Union or in the French Overseas Territories, the invoice will be issued without VAT. Any order delivered outside mainland France may be subject to any local taxes, customs duties, sea taxes and customs clearance fees upon delivery. Their payment is your responsibility. Check with the competent authorities of the country of delivery. However, goods purchased by professionals are purchased at the price agreed upon order within the limits of the option period and general economic conditions (taxes, exchange rates), at the time of delivery. On products dedicated to professionals, prices are understood to be excluding taxes, packaging, transport and freight insurance costs, ex seller's warehouse.
Any quantitative or qualitative modification of an order that has become final can only be accepted to the extent that it does not disrupt manufacturing or supply.
It could, if applicable, give rise to an increase in listed prices and would determine a new delivery time.
2.4. Order processing
Your orders are processed as quickly as possible by customer service. The seller will confirm your order and associated details by email or phone.
2.4.1. Unavailability
In case of failure to execute the contract resulting from the unavailability of the ordered goods, the customer is informed of this unavailability and may either proceed with an exchange, or be refunded without delay and at the latest within fourteen days of payment of the sums paid, or wait if the reissue of the goods is possible.
2.4.2. Confirmation
Upon validation of the order, the customer receives a confirmation by email.
2.5. Payment
The goods delivered and invoiced to you will remain the property of the seller until full payment of their price. Goods are payable upon order.
2.5.1. Payment of the price
The customer pays the price in cash, upon order or upon delivery, under the terms agreed between the parties.
2.5.2. Default of payment
In the exceptional event that the seller has accepted a staggered payment or a cash payment, failure to pay one of the installments results in the obligation to pay the price increased by 160 euros for costs incurred for the recovery of sums due (bailiff, bank charges, management fees, etc.).
The goods delivered and invoiced to you will remain the property of the seller until full payment of their price. Default of payment may result in the claim of goods by the seller, with immediate restitution and goods delivered at your expense, risks and perils.

2.5.3. Secure payment on the site
Our site uses a secure payment system.
In order to guarantee optimum security, we use SSL3 encryption technology. SSL3 secure payment is the most widely used and safest encryption system currently available to process your payment.
The E-transaction payment system used on our site in partnership with the MERCANET system of BNP PARIBAS uses this system to allow you to pay with complete peace of mind with your credit card.
2.6. Delivery
The seller retains full and exclusive ownership of the products sold until full payment of their price.
The seller undertakes to bear the transport risks except when the buyer collects the goods or deals directly with the carrier.
The quantity and qualities of the delivered item are those set on the order form.
The seller reserves the right to modify the item to be delivered in the scenario described in paragraph 2 of article R132-2 of the Consumer Code, that is to say when the modifications are related to technical evolution and do not generate any increase in price or alteration of the quality of the product.
By express agreement, a case of force majeure or events such as lock-out, strike, total or partial work stoppage at the seller's factory or at its suppliers', epidemic, war, requisition, fire, flood, interruption or delay in transport, legal or administrative measures preventing, restricting, delaying or prohibiting the manufacture or importation of goods, the seller is released from all liability at delivery. The seller will keep the buyer informed in due time of the cases and events listed above. In all cases, delivery within the deadlines can only take place if the buyer is up to date with his obligations towards the seller, whatever the cause.
Shipping charges and deliveries: Special provisions for Overseas Territories and Corsica:
- The transport cost rules (free or shipping charges) only apply up to forwarding to a port in mainland France, that is to say:
- Delivery to a freight forwarder in Le Havre or Marseille for Overseas Territories
- Delivery to a carrier in Marseille for Corsica
- All transport costs from the port to the final destination must be borne by the recipient
2.6.1. Shipping and processing charges
The delivery rates indicated are valid worldwide. Delivery of products outside mainland France is subject to a quote at the time of order.
Delivery is made according to availability and in order of arrival of orders. Your orders are processed as quickly as possible by the seller's customer service.
2.6.2. Deadlines
The indicated delivery times depend on the seller's supply and transport possibilities. Delays in delivery times cannot give rise to damages or withholding.
Shipments take place approximately 1 to 5 days after receipt of the order.
The times indicated on the site are average times usually observed and correspond to order processing times, to which is added the carrier's shipping time.
2.6.3. Delivery in France
After being dispatched by our logistics department, your order is delivered in France within 1 to 4 working days.
2.6.4. Delivery abroad
After being dispatched by our logistics department, your order is delivered within 4 to 15 days depending on the destination country. These times are for working days, excluding routing issues, depending on product availability, the chosen shipping method, destination and time of year.
The times indicated are those usually observed. These indications are given for information only and are not contractual. The seller is not responsible for the carrier's delivery times.
2.6.7. Customer's obligation upon delivery
Upon delivery, the customer must imperatively unpack the Products in the presence of the carrier. He must then check the conformity of the delivered Order in the presence of the carrier before signing the Delivery Note.
In case of any anomaly concerning the delivery, the Customer must indicate his reservations in the form of detailed, dated, explicit handwritten observations accompanied by his signature on the delivery slip.
These anomalies may be, for example:
- Damaged parcel: perforated, open, torn, etc…
- Non-conforming product in nature (reference error...) or in quantity.
In case of anomaly or non-conformity, the Customer must imperatively refuse the goods and must, as soon as possible, or the day of delivery, send his claims to the seller's Customer Service

Any claim made beyond 2 days following delivery cannot be accepted.
The expressions "subject to unpacking" or "subject to damage" are insufficient to prove the existence of damage. Your reservations must be clear, precise and detailed.
The absence of claims, the failure to issue reservations on the part of the Customer means that the delivered Product is deemed satisfactory and cannot be the subject of any subsequent contestation. For example, the Customer will not be able to issue a reservation to the seller after the carrier's departure, even if the package has not been opened in the presence of the carrier.
In case of non-conformity of the delivered goods with the ordered goods, after unpacking or at the time of delivery, the buyer may refuse the delivered products free of charge. The burden of proof of this non-conformity is the responsibility of the buyer. In case of non-conformity of the delivered product(s), the seller undertakes to refund or exchange the product(s) to his customer as soon as possible.
In case of payment upon receipt of goods, cash or installment payment, the customer must remit the total amount due, otherwise it will not be possible to proceed with the delivery of the goods. See article 2.5 of these general terms and conditions of sale.
As agreed in article 2.4.6 of these general terms and conditions of sale, the customer undertakes with the seller to implement the necessary means to overcome delivery difficulties.
3. Customer's obligation
3.1. Payment
The buyer pays the price in cash, upon order, under the terms agreed between the parties.
3.2. Delivery
Upon delivery, the customer must imperatively unpack the Product in the presence of the carrier. He must then check the conformity of the delivered order in the presence of the carrier before signing the delivery note.
Comply with article 2.6.7 of the general terms and conditions of sale.
3.3. Delivery difficulties
The customer undertakes with the seller to implement the necessary means to overcome delivery difficulties (equipment rental, additional labor, passage dimensions) in case the goods should be delivered with difficulty.
Comply with article 2.6.6 of the general terms and conditions of sale.
4. Seller's obligations
From article L121-20-3 of the Consumer Code, it follows on the one hand that the seller, as a professional, is liable by right to the consumer for the proper performance of the obligations resulting from the contract concluded at a distance, whether these obligations are to be performed by the professional who concluded this contract or by other service providers, without prejudice to his right of recourse against them; on the other hand, that he may be exonerated from all or part of his liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer, or to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure.
4.1. Information
The seller fulfills his duty of pre-contractual advice and information as derived from article L121-18 of the Consumer Code and the articles to which it refers. Thus, the seller fulfills in particular his obligation to inform the consumer of the essential characteristics of the good since it allows the consumer to obtain the detailed description of the products by going to the website www.palimex-oriental.com or by calling customer service at +33 1 46 86 36 33
By confirming the order, the seller meets the requirements of article L121-19 of the Consumer Code.
4.2. Items
The products offered comply with French legislation in force and the standards applicable in France and in the EEC.
4.3. Delivery
The quantity and qualities of the delivered goods are those set on the order form.
The seller reserves the right to modify the item to be delivered in the scenario described in paragraph 2 of article R132-2 of the Consumer Code, that is to say when the modifications are related to technical evolution and do not generate any increase in price or alteration of the quality of the product, it being understood that the consumer is free to mention the characteristics to which he subordinates his commitment.
5. Retention of title
The goods delivered and invoiced to you will remain the property of the seller until full payment of their price. Default of payment may result in the claim of goods by the seller, with immediate restitution and goods delivered at your expense, risks and perils.
6. Warranty
We do everything possible to ensure that our products and services give you complete satisfaction.
When a concern arises with an item, the customer is invited to contact customer service by going to the seller's website and using the CONTACT page, by sending an email (info@latitudedeco.com">palimex.shop@gmail.com) or by calling customer service at +33 1 46 86 36 33.
7. Return of Goods
Any return of goods requires a return number which can be obtained free of charge via the CONTACT page of the seller's website, by email (palimex.shop@gmail.com) or by calling customer service at +33 1 46 86 36 33.
The means of return will be at the initiative, convenience and expense of the customer. In no case can the seller be required to organize the return of cancelled goods.
The transfer of risks from the customer to the seller will only be considered effective upon receipt of the product at the seller's warehouse.
Products must imperatively be in good condition and returned in their original packaging, to which is added packaging covering the entire product; they must bear no trace of use, be accompanied by their accessories, assembly instructions and warranty certificate.
Only after verifying that these conditions are met will the seller proceed with the reimbursement of sums received for the returned goods, with the exception of initial shipping costs.
Otherwise, no refund will be payable, the customer will remain the owner of the product, which he can come to collect at the seller's warehouse

8. Termination clause
In the event of non-compliance with one of the buyer's obligations by the latter, the sale may be terminated as of right and the goods returned to the seller if he so wishes, without prejudice to any damages that the seller may assert against the buyer, within 48 hours after the formal notice has remained ineffective. In this case, the seller is authorized to claim from the buyer a flat-rate indemnity of 10% of the amount of the sale.
9. Data Protection Act
In accordance with law 78-17 of January 6, 1978 recast by law 2004-801 of August 6, 2004, you have a right of access and rectification of data concerning you. Through us, your address will not be transmitted to third parties. You will never receive proposals from other companies through our website.
9.1. Confidentiality of your data
The seller pays particular attention to the protection of your personal data and does everything possible to respect this right. When placing your order or requesting a catalog, the seller records, for the processing of your request, certain data such as: last name, first name and postal address. The seller is led to ask you for this information to organize commercial relations and the service the customer expects in the best possible way.
Email addresses are intended only for the seller's services. In e-mail shipments, the identity, brand or commercial nature of these proposals will be clearly specified in the subject of the message, which appears in the electronic mailbox.
At the bottom of the message, the customer will also find the possibility, by a simple click, to exercise his right to oppose the sending of any new prospecting message by e-mail.
9.2. Use of cookies
When consulting the seller's site, the latter collects, from the software activated by your own computer, data on the date, pages consulted, consultation time, as well as the IT address of your computer, the access provider, the search engine, the link originating this consultation.
This collection allows the seller to improve the ergonomics of its site and to strengthen the effectiveness of its services and in no case to carry out any advertising or commercial prospecting.
9.3. Data collected at the order
In order to process customer requests efficiently, the seller requests a certain amount of data: company, name, delivery and billing address, email address, phone number.
Some of these are essential for processing the order, others allow us to know the customer better and adapt offers to his needs. In no case will this information be given to a third party.
10. Intellectual property
All texts, comments, works, illustrations and images, whether visual or audio, reproduced on the seller's site are protected by copyright, trademark law, patent law and image rights, and this for the whole world. They are the full property of the seller or the manufacturer concerned.
As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes, subject to different or more restrictive provisions of the Intellectual Property Code, is authorized.
Placing a hyperlink to the seller's site, using the technique known as framing or deep linking, is strictly subject to written authorization from the company, upon simple request sent by email (info@latitudedeco.com">palimex.shop@gmail.com).
Any other use constitutes infringement and is sanctioned under Intellectual Property unless prior authorization from the seller.
Any total or partial reproduction of the seller's catalog is strictly prohibited, except with the express authorization of the seller.
11. Modification of the general terms and conditions of sale
The seller reserves the right to modify the general terms and conditions of sale at any time.
